well I finally emailed him again letting him know I know he is full of sh!t. Looks like he is coming around to his senses and I will take ownership but we'll see. I still keep getting more lies I believe, because now he apparently was in jail for a little and he needs all the money he can get for fines, i'm calling BS but we'll see where it ends up. Alright. LT is 100% right. The contract on ebay states he is legally obligated to deliver item. He could be doing one of two things. He could of actually been trying to scam you on it. It happens a lot Ebay dissapears. He cancels his ebay account and takes your money. I think he folded on it as soon as he found out you lived so close. Or he could have like you said just wanted more money.
What you need to do is contact ebay and file a failure to sell. They will overview the auction and as long as he did not end early or reserve the right to sell locally it will fall in your favor. Ebay will then contact the seller and warn him. If he does not comply, you have the right to bring law into it. The only thing that is going to hold you back is the fact that you have not payed. However, you tell ebay all the bs and show proof on the other forum sight and you have it made. DO NOT CONTACT the seller before notifying EBAY. THis will catch him off guard. GOOD LUCK. - The only other thing that could screw you over is if the seller has a buddy in the police who filed a stolen vehicle report. That would Suck. wish all the luck to you. - If you have any other question relating to ebay just ask. I run the Ebay account for the company I work for.

As far as i can tell it is pretty much resolved. I caught him with his lies and he even admitted it to the new emails he sent me. He pretty much said he just made shit up and he is will to work with me now knowing that I have filed a report with ebay and have all documents and papers showing he still had the quad. Like I said though we will see what happens, hopefully i can take delivery tomorrow

I doubt you will be able to do anything, it'd be impossible to prove it wasnt stolen, it was 100% him who posted it, and to get a judge to deal with an internet case like that.

Ebay is full of that crap, file a complaint. your lucky you didnt get ripped off

what do you mean by this? I didnt pay him cause he's pretty local, i would never fork out that much $$$ over the net, only cash exchange.

i took delivery yesterday of the quad, its gonna need some work but oh well should make a nice penny selling it once done

Im saying if he would have held his ground and told you to get lost, Theres not much i think you could have done.

I know what your saying but there are ways around that, just as if i didnt pay for my winning bid, unless something major happened to me or the item wasnt as described he has a right to hold me to the binding agreement and take me to court for payment or whatever costs
