Default Need major EBAY advise, BS Seller

Ok guys I won an ATV off ebay recently and it had a no reserve auction. To make a long story short the guy selling it emailed me saying the quad was stolen while he was away over the weekend. Now I didnt pay or anything yet because he isnt to far from so I was just going to go over and pick it up off him. Now when he emailed me and said it was stolen I asked him if it had really been stolen or he just wanted more money, and he got a real attitude about it sticking to the IT GOT STOLEN STORY. Well he is on another ATV site which I am a member on but he doesnt know its me over there and his quad was listed, so after all his bs about it being stolen I PM'd him and asked him he still had the quad, and what do you know, of course he still does, after a few PM's back and forth it turns out I am right and he wants more money. Now from what I can tell me winning the auction he is to follow through on his end. How do I approach this because i am more pissed now about him making up the whole bogus story and me busting his ass on it, I may of been a little more understanding if he just told me the truth from the beginning but he really has an attitude about this, and to top it off he said, " do you not understand my sh!t got stolen, if I wanted more money out of it I would have put a reserve" I have all his emails and PM's showing he is full of it and now I want my quad i just won. Any help would be great from someone who has any input. Thanks, oh and yes this was the short version!!!!

damn that sucks. first off. 1. waat was he sellin 2. how much did you win it for. i also think they dont have to sell it but i think you should just go to his house and talk to him or sumthin and find out whats goin on

Welll i won my quad on ebay too, just picked it up a few weeks ago luckily it went smooth... If you realy want the quad offer to buy it on the other site that you talk to him on. If he wants too much for it and your sure you cant get it then turn his ass into ebay cause peooople like that suck

If an item is sold on eBay the seller is legally obligated to sell it to you. It doesn't matter if it sold for $5 if the seller didn't put a reserve on it. That is his fault. If you wanted, you could get a lawyer involved and you would definitely win the case. When an item is sold, the buyer and seller enter into a legally binding contract. He is obligated to sell it, just as much as you are responsible to pay for it. If you won and decided not to pay, he could take you to court. But the bottom line is......is it really worth it to you to hire a lawyer?

well i did get the quad pretty cheap. Its an 03 troy lee edition predator 500, it went for $1425, although it does need minor work but what pisses me off the most is he's trying to pull this whole BS story on me even when I asked him about it. One of his main responses in the email I got was "If I wanted more money for the quad i would a put a reserve on it, dont you F'in understand I just got robbed?" So thats kinda what got me really pissed off because it is clearly the case he wants more money for it when i talk to him on the other ATV forum. I have never had any problems with ebay untill this and I really want to get this quad just cause of his outlook and really screw him over now. I can put a few hundred into it then sell it again, or just beat on it for a little now when i'm not riding my RM. As for a lawyer, a few close friends of the fam are lawyers so I guess i could also ask them about it, but my main thing is if he knows I'm coming for it then he can just stash it somewhere like his buddies house and deny that he has it.

THAT SUMS IT ALL UP RIGHT THERE!!! he didn't end the auction early or anything so legally he has to sell it to you!!!!!!

even if he hides at a friends house since he is legally bound to sell you the quad all your lawer friends have to do is get a copy of the police report that he should have filed if it was so called "STOLEN" this guy is a duoche bag and needs to be taught a lesson... file the claim with ebay and tell him your lawer friends to call him asking for copies of the police reports and basically call him on his bluff..

calling my lawyer tomorrow to see what I can do and how to really approach it, I'm going to try and set it up so I have whatever legal documents I need and hopefully just go there and get a local officer to assist me and make sure nothing happens. I am just heated right now if i saw this punk I would hurt him. I think on top of all this what is also getting me is that I gave up 3 other auctions since i won this one, which i could of easily won the others as well but since I won this one I could fund 2 seperate bikes at the same time
