Default need help on legal actions!!

its time to get messy i 've given cp customs wayyyy more then enough time to get back to me and haven't heard a thing its been over 45 days since i sent in the payment paypal ... i was thinking about trying to file the claim anyways... but what do you guys think? i need to do something i'm out a cylinder and $700 i'm not anywhere near the shop so what do i do?

Im not a lawyer but I've had the fortune/misfortune of many legal situations in my life.
To file a small claims case (which I believe is up to $5k) you might have to file in the shops district, It obviously will be for the price of the cylinder plus the $700. You have to pay a filing fee (like $50 for small claims) at the appropriate courthouse plus the fee for the sherrif to serve it so your looking at roughly $150 in costs (which I believe you might be able to include in your case, No lawyers are typically allowed in small claims so you don't have to worry about hiring one or him showing up with one). The Courtdate will be set and you both have to provide all of your files to each other before you go in front of the judge, You start and the def. has the last word. Then you leave and the judgement is sent to you in the mail, Also you can add your travel expenses to it and any lost wages (as long as you dont go over the $5k limit). You'll get a settlement and if he doesn't pay the court will enforce it and a lien will go on his credit report. You also (I might add) get an oppurtunity before you face the judge to have a face to face mediation (kinda of a last effort to avoid legal action/court) if you think you might be close on terms and could possibly reach a mutual agreement within the presence of a professional mediator.

yeah definitly not good bussiness ethics... a phone call would clear this whole thing up.... i sent my cylinder out to get some work done... everything was pretty cool at first ... they returned calls were right on getting back to me and then i got my cylinder back and started having problems... the first ride the damn thing blew... i called the guys and he said just put a new head gasket it would be fine... i bought a new head gasket but i was really busy with work and life so it took me a few months to get around to it ... i finally got around to it about month in a half ago... i decided to look and see what they did because i had it apart and noticed the work they did was obviously not right...i'm no machinist but it had pits still in the cylinder walls, and what looked like some shotty boring, and the head looked chewed up too... so i called craig(cp customs) back up and sent hime some pics... he said that they just fired some guy that probably was the cause and told me to ship it back in and he'll bore it again and buy a piston at their expense.... its been over a month i can't get a hold of him, emails, phone, anything.... its pissing me off... i mean i could understand if something happened serious, or was really busy , trip, whatever but let me know... i 'm a bussiness man i know how it goes shit happens and sometimes you gotta suck it up and take the heat... i don't like being put in a situation where i don't know whats going on... and half to guess or assume things... i'd like to think that they'll take care of it like he said but this is rediculus... i just wanna go freaking riding!

da*n man sorry to hear that.i have never heard anything bad about the company.but i have also not heard alot about them period.i know they are supposed to build some bad blasters.it may all work out.but anyway not contacting you is bad enough.i sure as he** would want to know where my stuff is and whats going on.

i figure i'll just keep trying to contact them ... the philosophy of the sweekiest wheel will hopefully get oiled first lol... because i really don't want to have to hassle with all the freaking legal bull... i'm not the only one come to find out somebody on they're forum has been trying to get ahold of them and hasn't been able to either... i tried calling again and they're inbox is full ... so somethings up... we'll just have to wait and see i'll keep you guys posted... worst case anybody got a nice duner cylinder for a 3mm

still no word... i found some info that would be good for anybody having problems though... get ahold of the better bussiness buro and the atterney general... file a complant online and they'll get people butt moving from what i hear... thats what i'm gonna do first and see how that goes... if no response then i'll have to kick it to the next gear...
